These terms govern your use of delights.co.ke and the general basis on which Delights Web Services ("DWS") provides IT services and software. Specific projects are governed by a written quote, proposal or agreement, which prevails if it conflicts with these terms.
You may use this website for lawful purposes only. Content on the site is provided for information and does not constitute a binding offer until confirmed in writing by DWS. We may update the site at any time.
Quotes state the scope, price and validity period. Prices shown on the website, including the rate card, are guides and may change. Payment terms, including deposits and milestones, are set out in each quote or invoice. We accept M-Pesa and bank payments. Work outside the agreed scope is quoted separately.
You agree to provide timely access, information and decisions we reasonably need, and to make sure you have the right to any data, content or systems you ask us to work on.
Unless agreed otherwise in writing, you own the content and data you provide, and DWS keeps ownership of its pre-existing tools, methods and code. Custom work becomes yours on full payment as stated in your agreement. Third-party software we install or resell (for example Perfex CRM and other platforms) remains subject to its own licence terms.
We keep client information confidential and process personal data as described in our Privacy Policy and in line with the Kenya Data Protection Act, 2019.
We perform services with reasonable skill and care. Except as required by law, we do not guarantee uninterrupted or error-free operation of software or third-party services. To the extent the law allows, DWS's total liability for any claim is limited to the fees paid for the service that gave rise to the claim, and DWS is not liable for indirect or consequential loss.
Support hours, response times and uptime commitments apply only where stated in your written agreement.
Either party may end a project or support agreement by written notice as set out in the agreement. Fees for work done and costs incurred up to termination remain payable.
These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction, after the parties first try in good faith to resolve any dispute.
